A 57-year-old Grafton man will serve 12 years in prison for a hit-and-run that killed a Yorktown woman on Super Bowl Sunday 2015.
Alyssa Lynne Rhoades, 23, died after she was hit by a car that failed to stop on Route 17 near Grafton Drive in York County on Feb. 1, 2015.
Another man was injured during the accident.
Both victims were taken to Riverside Regional Medical Center in Newport News where Rhoades died. The other victim was released from the hospital the next day, said York County Commonwealth’s Attorney Benjamin Hahn.
Kevin Anthony Boone was arrested for the crime on May 6, 2015.
Evidence against Boone was circumstantial; the windshield wipers belonging to his mother’s car were found at the accident scene, and the car’s windshield was damaged. There was no DNA evidence linking the car to the victims, Hahn said.
There was no evidence that Boone was drunk at the time of the accident, Hahn said.
“We had no firm evidence showing intoxication. The evidence would have show that the defendant and our witnesses were drinking and consuming alcohol all day during the Super Bowl, but we had nothing to show what the blood alcohol level was,” Hahn said, adding that Boone wasn’t arrested until three months after the accident.
Boone entered Alford pleas to aggravated involuntary manslaughter, driving under the influence with a victim permanently impaired and hit-and-run with a victim injured in the York-Poquoson Circuit Court on Tuesday.
An Alford plea is a guilty plea in which the defendant maintains their innocence but recognizes that there may be enough evidence against them to be convicted.
Boone was sentenced to 35 years in prison with 23 years suspended, and 105 years of supervised probation, Hahn
The sentencing was a result of a plea agreement between the prosecution and defense, and came a day before a scheduled two-day jury trial, said defense attorney Romeo Lumaban.
Boone was also charged with second degree murder, prior driving while intoxicated manslaughter, involuntary msaid.anslaughter and operating a vehicle with a revoked license.
Those charges were nolle prossed, which means the prosecution agreed not to pursue them, Hahn said.
The fatal accident was not the first time Boone faced a judge for charges related to alcohol.
He was convicted of public intoxication in the York-Poquoson Circuit Court in 2012. He served no time for the charge.
Boone was also convicted of a third or subsequent offense of driving while intoxicated in Williamsburg/James City County Circuit Court in 2012. He was sentenced to 5 years for that charge and served 1 1/2 years in jail.
Boone was also sentenced seven years of supervised probation for the DWI. He will appear in Williamsburg/James City County Circuit Court for a felony probation violation on May 23.
